Recent Tamil Nadu election results revived debate on the Governor’s role in inviting parties to form government in a hung Assembly. Supreme Court judgments such as S. R. Bommai v. Union of India and Rameshwar Prasad v. Union of India clarified that the Governor cannot question how majority support is secured by a post-poll alliance or the single largest party.

The Court held that preventing a party from staking claim to form government on speculative grounds would damage democratic governance and constitutional principles.
