The Opposition has initiated a motion seeking removal of Om Birla, triggering the constitutional process for examining the Speaker’s removal.
A no-confidence motion against the Speaker is a resolution to remove the Speaker or Deputy Speaker of the Lok Sabha before completion of tenure. This mechanism applies only to the Lok Sabha and not to the Rajya Sabha, as the latter has a Chairman (Vice-President of India) under a different constitutional scheme.
The legal basis lies in Article 94(c) of the Constitution, which provides that the Speaker or Deputy Speaker may be removed by a resolution passed by a majority of all the then members of the House. The motion must comply with prescribed notice requirements and is taken up for consideration as per parliamentary procedure.
