If a Chief Minister refuses to resign despite losing majority support, constitutional provisions prevent continuation in office without legislative confidence. Under Article 164 of the Constitution of India, the Council of Ministers remains in office only so long as it enjoys the confidence of the Assembly.
In such situations, the Governor may order a floor test to verify majority support. Failure to prove majority can result in dismissal of the government and invitation to another party or alliance capable of forming the government.
