In a landmark move, the Supreme Court of India recently overturned the result of a sarpanch election in a Panipat village, Haryana, and ordered a recount of votes by summoning the Electronic Voting Machines (EVMs) to its own premises in New Delhi. This marks the first known instance of the apex court directly undertaking a recount of EVM votes, underlining its supervisory powers to ensure the integrity of electoral processes.
Under Indian law, the validity of Parliamentary, Assembly, or State Council elections can be challenged only through an election petition before the respective State High Court. For local body elections such as those of panchayats and municipalities, disputes are adjudicated by district-level civil courts. The right to file such petitions lies with either a contesting candidate or an elector connected to the election in question.
The case highlights the layered judicial mechanism available to challenge electoral results while also demonstrating the Supreme Court’s role as the final arbiter in safeguarding the democratic process. It sets a precedent for judicial scrutiny over local elections, reinforcing transparency, accountability, and faith in electoral institutions.
